The Federal Circuit and the Supreme Court

The Hon. Randall R. Rader, Court of Appeals for the Federal Circuit, Washington, D.C.

Judge Rader addressed recent decisions of both the Federal Circuit and the Supreme Court. He discussed, inter alia, the Supreme Court's decisions KSR v. Teleflex and Ebay v. Merckexchange and their impact on the Federal Circuit's and the district courts' jurisprudence. Furthermore, he discussed the Federal Circuit's decision in Quanta v. LG Electronics addressing the question of patent exhaustion and, as far as predictable, the Supreme Court's position on this question. Moreover, he placed the decisions in the larger context of the renewed interest in IP the Supreme Court has taken in recent years and its impact on the relationship between the Supreme Court and the Federal Circuit.
